These Terms of Service govern your use of Tides Today, including our website at tides.today, our mobile applications, widgets, APIs, developer tools, data feeds, content, forecasts, tide predictions, weather information, maps, charts, downloadable content, and any related services we provide.

By accessing or using Tides Today, you agree to these Terms. If you do not agree, you must not use Tides Today.

1. Who we are

“Tides Today”, “we”, “us” and “our” refers to Stephen Wright.

“You” and “your” refers to any person who accesses or uses Tides Today, including website visitors, mobile app users, API users, developers, and anyone relying on information made available through our services.

2. Important safety warning

You are responsible for your own safety at sea. All tidal predictions are indicative only and are generated from scientific models and publicly available datasets. No guarantees are made regarding the accuracy, completeness, or suitability of data on this website, in our apps, or through any related Tides Today service.

Tides, weather, sea state, currents, swell, wind, barometric pressure, local geography, harbour conditions, river flow, coastal works, equipment failure, data errors, and other factors can affect real-world conditions.

Tides Today must not be used as your sole source of information for navigation, boating, swimming, diving, fishing, kayaking, paddleboarding, sailing, coastal walking, beach visits, emergency planning, commercial maritime operations, or any activity where inaccurate information could result in injury, death, property damage, financial loss, or environmental harm.

You must check official, local, and up-to-date sources before making decisions, including where appropriate:

  • official hydrographic offices;
  • harbour authorities;
  • coastguard or maritime safety bodies;
  • local notices to mariners;
  • weather warnings;
  • navigation charts;
  • tide tables issued by competent authorities;
  • local signage and safety warnings.

You use Tides Today entirely at your own risk.

3. No professional, navigational, emergency, or safety advice

Tides Today provides general information only.

Nothing on Tides Today is professional maritime advice, navigational advice, weather advice, safety advice, emergency advice, legal advice, commercial advice, or any other professional advice.

Tides Today is not a replacement for:

  • official navigation charts;
  • marine instruments;
  • professional seamanship;
  • local knowledge;
  • coastguard guidance;
  • weather warnings;
  • harbour authority instructions;
  • emergency services.

You must not rely on Tides Today in an emergency. In an emergency, contact the relevant emergency services or coastguard.

4. Accuracy of tide, weather, moon, and location data

We aim to provide useful tide times, tidal predictions, weather information, moon phases, spring and neap tide information, coastal location data, and related content.

However, all such information may be inaccurate, incomplete, delayed, unavailable, outdated, wrongly localised, wrongly converted between units, affected by modelling assumptions, or unsuitable for your particular use.

Tidal predictions may be generated from scientific models, third-party sources, public datasets, harmonic constituents, weather data, astronomical calculations, location metadata, or other sources. These may contain errors or limitations.

We do not guarantee that:

  • tide times are accurate;
  • high and low water heights are accurate;
  • weather forecasts are accurate;
  • moon phase or astronomical data is accurate;
  • spring and neap tide dates are accurate;
  • locations are correctly named, translated, geocoded, grouped, or mapped;
  • data is available at all times;
  • data is suitable for marine navigation or safety-critical use;
  • data will match official tide tables, harbour data, local measurements, or real-world conditions.

5. Website use

You may use the Tides Today website for personal, non-commercial, informational purposes, subject to these Terms.

You must not misuse the website, interfere with its operation, attempt to bypass technical protections, scrape data at scale, overload our systems, copy substantial parts of the service, or use the website in any unlawful, harmful, abusive, or unauthorised way.

6. Mobile app terms

These Terms also apply to any Tides Today mobile app, including apps distributed through Google Play, the Apple App Store, Expo, TestFlight, internal testing, direct download, or any other distribution method.

By installing, accessing, or using the app, you agree that:

  • the app provides general tide, weather, moon, coastal, and location information only;
  • the app must not be used as your sole source of safety, navigation, weather, or maritime information;
  • app data may be cached, delayed, unavailable, incomplete, inaccurate, or affected by poor connectivity;
  • push notifications, reminders, widgets, saved locations, calendar entries, offline views, or alerts may be delayed, fail to arrive, or contain outdated information;
  • device location, if used, may be inaccurate and may not reflect your actual position;
  • the app may depend on third-party services, operating systems, app stores, advertising networks, analytics services, mapping services, notification services, and network providers;
  • we may update, change, suspend, restrict, or withdraw the app or any app feature at any time.

You are responsible for keeping your device, operating system, app version, permissions, notification settings, and connectivity suitable for your use.

You must not reverse engineer, decompile, modify, resell, abuse, overload, scrape, automate, or interfere with the app, its APIs, or its backend systems except where applicable law expressly allows this.

7. App stores

If you download the app from Google Play, the Apple App Store, or another app marketplace, you may also be subject to that store’s terms, policies, and billing rules.

The app store provider is not responsible for Tides Today’s content, data, predictions, support, or claims, except where that provider’s own terms say otherwise.

For Google Play and Apple App Store compliance, you should also maintain a proper privacy policy inside the app and in the store listings.

8. Advertising, analytics, and third-party services

Tides Today may display advertising or use analytics, crash reporting, performance monitoring, maps, app store services, payment providers, notification services, or other third-party tools.

These third parties may process data in accordance with their own terms and privacy policies.

Where required, we will ask for consent before using non-essential cookies or similar technologies.

Advertising shown on Tides Today does not mean that we endorse the advertiser, product, service, or claim.

9. Accounts, API keys, developer access, and automated use

If Tides Today provides accounts, API keys, developer tools, widgets, embeddable scripts, or data access, you are responsible for keeping your credentials secure.

You must not:

  • share API keys publicly;
  • bypass rate limits;
  • resell or redistribute data without permission;
  • use the service to build a competing tide data service without written consent;
  • scrape or bulk-download data;
  • use automated tools in a way that harms availability or performance;
  • misrepresent Tides Today data as official, certified, guaranteed, or safety-critical;
  • remove attribution where attribution is required;
  • use Tides Today data for emergency, navigational, or safety-critical purposes.

We may suspend, revoke, throttle, or terminate access to accounts, API keys, widgets, apps, or services where we reasonably believe these Terms have been breached, the service is being abused, or continued access creates operational, legal, security, safety, or commercial risk.

10. Intellectual property

Unless otherwise stated, Tides Today owns or licenses the content, design, layout, graphics, branding, software, code, data presentation, text, icons, logos, and other materials made available through the service.

You may not copy, reproduce, republish, modify, sell, licence, scrape, redistribute, frame, mirror, or exploit any part of Tides Today without written permission, except where allowed by law or expressly permitted by us.

Third-party trademarks, datasets, services, or content remain the property of their respective owners.

11. User content and submissions

If you send us feedback, corrections, translations, location updates, reviews, suggestions, bug reports, or other material, you grant us permission to use, edit, publish, adapt, and incorporate that material into Tides Today without payment to you.

You must not submit anything unlawful, misleading, defamatory, abusive, infringing, malicious, or harmful.

12. Changes to the service

We may change, update, suspend, discontinue, restrict, remove, or replace any part of Tides Today at any time, including tide data, weather data, locations, features, APIs, widgets, app functionality, supported languages, pricing, advertising, and availability.

We do not guarantee that Tides Today will always be available, uninterrupted, secure, error-free, or compatible with your device, browser, operating system, or integration.

13. Third-party links and data sources

Tides Today may contain links to third-party websites, services, datasets, app stores, advertisers, social media platforms, or external resources.

We are not responsible for the availability, accuracy, content, policies, practices, security, or reliability of third-party websites or services.

Links are provided for convenience and do not imply endorsement.

14. Prohibited uses

You must not use Tides Today:

  • unlawfully;
  • fraudulently;
  • to harm, threaten, abuse, or harass others;
  • to interfere with the service;
  • to introduce malware, exploits, or harmful code;
  • to reverse engineer or attack our systems;
  • to harvest, scrape, or bulk extract data;
  • to bypass security, access controls, or rate limits;
  • to create a competing product or dataset without permission;
  • for safety-critical, emergency, navigational, or life-critical decisions;
  • in a way that could damage Tides Today, its users, its infrastructure, its reputation, or third-party services.

15. Disclaimer of warranties

Tides Today is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we exclude all warranties, representations, conditions, and guarantees, whether express or implied, including warranties of accuracy, availability, reliability, completeness, fitness for a particular purpose, non-infringement, compatibility, and performance.

We do not guarantee that Tides Today will meet your requirements or that any data, prediction, forecast, calculation, location, translation, chart, alert, or result will be accurate, timely, complete, or suitable for your use.

16. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

Subject to that, and to the fullest extent permitted by law, we are not liable for any loss, damage, injury, claim, cost, expense, or consequence arising from:

  • reliance on tide predictions, weather forecasts, moon data, location data, or other information;
  • inaccurate, incomplete, delayed, unavailable, or unsuitable data;
  • failure to check official or local sources;
  • use of Tides Today for navigation, safety, emergency, commercial, or operational decisions;
  • app errors, notification failures, cached data, device issues, or connectivity problems;
  • third-party services, datasets, adverts, links, app stores, analytics, or APIs;
  • interruption, downtime, data loss, cyberattack, unauthorised access, or technical failure.

We are not liable for indirect, consequential, incidental, special, punitive, business, reputational, loss-of-profit, loss-of-revenue, loss-of-data, loss-of-goodwill, or opportunity losses.

17. Indemnity

If you use Tides Today in breach of these Terms, misuse our data, overload our systems, infringe our rights, breach the rights of others, or use the service for unlawful or safety-critical purposes, you agree to be responsible for any resulting claims, losses, liabilities, damages, costs, and expenses, including reasonable legal costs, to the fullest extent permitted by law.

18. Privacy

Your use of Tides Today is also governed by our Privacy Policy.

The Privacy Policy should explain what data we collect, how we use it, how long we keep it, who we share it with, and your rights.

For the mobile app, the Privacy Policy should specifically cover app analytics, advertising SDKs, crash logs, device identifiers, approximate or precise location, push notifications, saved locations, API calls, and any third-party services used by the app.

19. Termination

We may suspend, restrict, or terminate your access to Tides Today if we reasonably believe that:

  • you have breached these Terms;
  • your use creates risk for us, users, infrastructure, data providers, or third parties;
  • your use is unlawful, abusive, excessive, automated, or harmful;
  • we are required to do so by law, platform policy, app store policy, regulator request, or third-party provider requirement.

20. Severance

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts will continue to apply.

21. No waiver

If we do not enforce a right immediately, this does not mean we have waived that right.

22. Changes to these Terms

We may update these Terms from time to time. The updated version will apply from the date it is published, unless stated otherwise.

If we make significant changes, we may take reasonable steps to notify users, such as by updating the website, app, or relevant policy page.

Your continued use of Tides Today after changes are published means you accept the updated Terms.

23. Governing law

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes arising from or relating to these Terms, except where consumer protection law gives you the right to bring proceedings elsewhere.
